Durable
Power of Attorney Power of Attorney: At different times in your life it might be necessary to have someone transact business on your behalf or to make decisions for you. For example, if you are not incapacitated, yet just out of town during your house sale, you can give power of attorney to someone who can then act on your behalf. Durable Power of Attorney: What if you are incapacitated? A Durable Power of Attorney will "endure" your incapacity. This is a document you have drawn up now and you appoint the person now who would act on your behalf. Generally a spouse is appointed along with a back up person. At Common Law, a power of attorney can be issued but it only gives the Agent the power to execute what the Principal had at that moment. This becomes a great problem if the Principal is ill or incapacitated. Since the Principal can not perform the act, the Agent cannot perform the act. This problem is remedied by a Durable Power of Attorney which remains in effect during the Grantor's incapacity. As an example, a health care durable power of attorney allows an agent to make health care decisions for a patient who has become incompetent or comatose. |
